Auction Terms & Conditions 1. You must be over the age of 18 to bid on vehicles. 2. Auction reserves the right to reject any or all bids and to withdraw any vehicle or other items for any reason. 3. Western Towing is not responsible for loss, theft, or damage to vehicles that are not immediately paid for and removed from the property. 4. All vehicles are assessed a Buyers Premium. The Buyers Premium is: Public-10% of sales price. Minimum $55.00 per vehicle Dealers-5% of sales price. Minimum $35.00 per vehicle Lot removal fee of $10.00 will be charged to all vehicles Late fee is $25.00 a day per vehicle. 5. The sole and exclusive remedy for breach of contract of warranty shall be return of the vehicle and repayment of the sales price. Under no circumstances, shall Western Towing be liable for consequential or incidental damage; including but not limited to repairs, improvements, loss of use and MVD Registration fees. 6. Western Towing may have a lien and or bid on items in this auction. 7. Western Towing hereby disclaims and excludes any and all warranties of title, including without limitation that the title is good and its transfer is rightful and that the vehicle is delivered free from any security interest or other lien or encumbrance. Western Towing also disclaims and excludes any and all warranties that the vehicle is delivered free from any rightful claim of any third party by way of infringement or the like. All vehicles are sold "AS IS WITH ALL FAULTS". Western Towing hereby disclaims and excludes any and all implied warranties, including without limitation the implied warranties of merchantability and fitness for a particular purpose. 8. Any bidder who fails to pay for and pick up their purchases on or before the specified pickup date time will not be allowed to register for future auctions. 9. Sales tax @ 8.6% will be assessed on all Non-Dealer transactions 10. $25 and up key fee will be added where applicable 11. Vehicles available at auction are subject to change. 12. A Bill of Sale will be provided on all vehicles or other items sold at the auction, All titles will be placed under Registered bidder unless proof of I.D. is shown. No open titles. 13. Any items not paid for within 5 working days of auction closing will be relisted and or sold at Western discretion. 14. Payments on vehicles or other items purchased are to be made only in cash, cashier check, pre-approved company check, or credit card (credit card will incur a 3% fee). 15. The information provided by Western Towing descriptions,etc is not guaranteed correct. 16. All sales are final, No refunds. 17. Bidder are urged to inspect each vehicle or other items and bid according to their own observations. No guaranteed is made on year, make, model, or condition.
